Terms of Service: User Agreement & Usage Rules

1. Purpose and Scope

These Terms of Service (“Terms”) govern your access to and use of the Fortunepia website, applications, and all related services (collectively, the “Service”) provided by us.

By accessing or using the Service, creating an account, or purchasing any paid feature, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Service.

These Terms apply to all users of the Service (“User”, “you”).

2. Nature of the Service – Entertainment and Self-Reflection

  1. Overview of the Service
  2. Fortunepia combines large language models (LLMs) with Western astrology rules to provide, among other things:

    • Astrology-based AI text interactions (chat)
    • AI Voice Interaction features, where you speak and receive responses in audio form
    • Paid astrology reports
    • Free horoscopes and other astrology-related content.

The specific features, content types, and methods of providing the Service may change from time to time at our discretion.

  1. Not Professional Advice
  2. All content provided through the Service (including text, audio, reports, horoscopes, and any other messages or outputs) is offered solely for entertainment and self-reflection purposes. It does not constitute professional advice of any kind, including but not limited to:

    • Medical or healthcare advice
    • Psychological, counseling, or mental health advice
    • Legal, tax, financial, or investment advice
    • Career or business advice
    • Professional advice regarding interpersonal relationships or personal concerns.

You must not treat any content from the Service as a substitute for advice from qualified professionals. Important decisions affecting your health, finances, legal status, relationships, or life circumstances should be made only after consulting appropriate professionals.

  1. No Clinical or Therapeutic Services
  2. We do not provide:

    • Diagnosis or treatment of any physical or mental health condition
    • Psychotherapy, counseling, or any licensed mental health service
    • Legal, tax, investment, or other regulated professional services.
  3. Not for Crisis or Emergency Use
  4. The Service is not designed for crisis intervention or emergency use.

    • If you are in crisis, considering self-harm or harm to others, or otherwise in an emergency, you must immediately contact your local emergency number, crisis hotline, medical provider, or other appropriate authority.
    • You must never delay seeking professional help or ignore professional advice because of any information or content obtained through the Service.
  5. No Guarantee of Accuracy or Outcomes
  6. Due to the nature of astrology and AI-generated content:

    • Interpretations, predictions, and recommendations may involve subjective and speculative elements
    • We do not guarantee that any content is accurate, complete, or reliable
    • We do not guarantee any particular result, outcome, or change in your circumstances.

AI outputs may be incomplete, biased, or incorrect. You understand and agree that you use the Service at your own risk and remain solely responsible for your actions and decisions.

3. Eligibility

  1. General Intended Audience
  2. The Service is intended for general users and is not designed for children under 13. By using the Service, you represent and warrant that you are at least 13 years old.

  3. Minors
  4. If you are under the age of 18 (or under the age of majority in your jurisdiction):

    • You may only use the Service with the consent and supervision of your parent or legal guardian
    • Your parent or legal guardian is responsible for your use of the Service and for ensuring that your use complies with these Terms.
  5. Legal Capacity and Restrictions
  6. You represent that you have the legal capacity to enter into a binding agreement and that you are not prohibited from using the Service under any applicable law or regulation.

  7. Territorial Restrictions
  8. We may restrict or limit access to the Service, or certain features, in specific countries or regions if required by law or for business or technical reasons.

Accounts and Security

  1. Account Creation
  2. To use certain features (such as paid services, history tracking, or saved sessions), you may be required to create an account. When creating an account, we generally require only:

    • An email address; and
    • A password.

We do not require your real name or your phone number to create an account. You may choose a display name or nickname within the Service if such a field is provided, but it does not need to be your legal name. We do not require your birth data solely for account registration.

  1. Astrology-Specific Information (Birth Data)
  2. To generate astrology-based content (such as certain readings, horoscopes, or paid reports), we may ask you to provide birth data, such as:

    • Date of birth
    • Time of birth
    • Place of birth (e.g., city and country).

Providing this information is voluntary, but it may be necessary to receive specific astrology features. Birth data that you provide is processed to generate the requested content and may be handled in accordance with our Privacy Policy, which explains:

  • What we store
  • For how long
  • How you can request deletion or exercise your data rights.
  1. Accuracy and Updates
  2. You agree to provide accurate, current, and complete information where requested, and to promptly update such information if it changes. Using false information, impersonating another person, or creating duplicate or fraudulent accounts is prohibited.

  3. Account Security
  4. You are solely responsible for maintaining the confidentiality and security of your login credentials and for all activities that occur under your account. You agree to:

    • Immediately notify us at support@fortunepia.com of any suspected unauthorized use of your account
    • Take reasonable steps to protect your account, such as using a strong password and logging out after use.
  5. Suspension or Termination of Accounts
  6. We may suspend, restrict, or terminate your account, with or without notice, if we reasonably believe that:

    • You have violated these Terms or any applicable law
    • You are using the Service without appropriate consent (e.g., as a minor without guardian consent)
    • You are engaged in fraud, abuse, hacking, or other harmful conduct
    • We are required to do so by a court, regulatory authority, or by our service partners.

5. Paid Services and Balance

  1. Types of Paid Services
  2. We may offer the following types of paid services (among others):

    1. AI Voice Interaction Sessions
      • You speak using your device’s microphone
      • We convert your speech into text using speech recognition (STT)
      • An AI model generates a response
      • We play the response back to you using text-to-speech (TTS).

This feature may be billed per minute, per session, or as part of a package. It is provided over internet data and does not constitute a traditional telephone call over a telecommunications carrier network.

    1. AI Chat Sessions
      • You interact with the AI via text-based chat
      • Billing may be per message, per minute, per session, or per package.
    2. Paid Astrology Reports
      • One-time digital reports generated based on information you provide (which may include birth data when needed for that particular report)
      • Typically delivered to your account or email after purchase.
    3. Balance
      • A virtual currency used within the Service to access paid features
      • May be acquired by purchasing it or received as part of promotions, events, or other programs.
  1. Nature of Balance
    • “Balance” represents a limited, personal, non-exclusive, non-transferable, revocable right to access certain paid features within the Service.
    • Balance is not legal tender, not a bank deposit, not stored value, and not e-money.
    • Balance has no monetary value outside the Service and cannot be redeemed for cash, except where required by law or explicitly stated by us.
    • o Unless we expressly permit it in the Service, you may not sell, trade, or transfer Balance to any other person or account, nor may you transact with Balance outside the Service.
  2. Pricing, Taxes, and Fees
    • Prices, billing units, included usage (e.g., minutes, messages), and applicable taxes will be shown at the time of purchase.
    • You are responsible for any additional charges from your mobile carrier, internet provider, or payment provider (e.g., data charges, foreign transaction fees).
  3. Payments
    • Payments are processed by third-party payment processors, app stores, card networks, or other payment services.
    • By providing payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processors) to charge all applicable fees.
  4. Promotional Balance
    • We may provide free or promotional Balance (“Promotional Balance”) as part of campaigns, events, or reward programs.
    • Promotional Balance may be subject to additional terms, including expiration dates or usage restrictions, which will be disclosed at the time of issuance.
    • Unused Promotional Balance may expire or be revoked in accordance with those terms and applicable law.

6. Cancellations, Refunds, and Balance Policy

  1. Digital Nature of the Service
  2. The Service consists of digital and intangible content (AI interactions, digital reports, etc.). Once provided, such content cannot be “returned.” Therefore, completed services are generally non-refundable, except where these Terms or applicable law provide otherwise.

  3. Scheduled Sessions (if offered)
  4. If we offer scheduled sessions at a specific future date or time:

    • Cancellation before the start time:
    • If you cancel within the time frame indicated in the Service (e.g., a certain number of hours before the start), we may refund the amount paid or restore the Balance used for that session.

    • Late cancellation or no-show:
    • If you cancel after the session has started or do not attend without proper notice, we may treat the session as fully used, and no refund will be provided, unless required by law.

  5. On-Demand Sessions and AI Voice Interaction
  6. For sessions or features that begin immediately when you press “Start” or a similar button:

    • Once a certain level of usage has occurred (for example, multiple messages exchanged, or a threshold duration of interaction), the session is considered substantially delivered and is generally not refundable.
    • However, if:
      • A clear technical failure attributable to us (such as a major outage of our systems) prevents the session from starting or being meaningfully used; or
      • Applicable consumer protection laws require a refund, we may, at our reasonable discretion:
      • Restore equivalent Balance to your account; or
      • Provide a partial or full refund for the affected portion.
  7. Paid Astrology Reports and Other Digital Content
    • Paid reports are typically generated and delivered shortly after your purchase.
    • Once a report or similar digital content has been delivered to your account or email, the purchase is generally non-refundable.
    • Exceptions may apply if:
      • The content was never delivered due to our fault
      • The content is materially defective such that it cannot reasonably be used;
      • A refund is required by applicable law.
  8. Refunds of Balance
    • Purchased Balance is generally not refundable in cash, except where:
      • Required by applicable law; or
      • We decide to provide a refund in the context of shutting down the Service or a similar event.
    • If we fully discontinue the Service and you cannot reasonably use your remaining purchased Balance, we will provide guidance on refunds or other remedies as required by applicable law.
    • Unauthorized or fraudulent payments are handled in coordination with the payment provider (e.g., card issuer, app store) and in accordance with applicable law and their rules.
  9. How to Request a Refund or Adjustment
    • If you believe you were incorrectly charged or that a session or content was not delivered as described, you must contact us at support@fortunepia.com within 30 days of the relevant transaction.
    • We may request additional information (logs, screenshots, etc.) to investigate.
    • We will determine whether a refund or Balance adjustment is appropriate based on applicable law and our internal policies.

7. AI Voice Interaction and Chat Features

  1. Definition of AI Voice Interaction
  2. “AI Voice Interaction” means a feature where:

    • You speak through your device’s microphone
    • We convert your speech to text using speech recognition (Speech-to-Text, STT)
    • An AI model generates a response based on that text
    • We play the AI response back to you using text-to-speech (TTS).

AI Voice Interaction is provided over internet data and does not use traditional carrier voice networks. It is not a traditional telephone call.

  1. Infrastructure and Third-Party Services
    • AI Voice Interaction may rely on third-party services that provide STT, TTS, and audio streaming.
    • We use contracts and technical measures to help ensure service quality and security, but we do not control these third-party providers’ infrastructure in full.
  2. Network and Device Issues
  3. We are not responsible for any audio quality issues, interruptions, latency, or failures arising from:

    • Your device configuration or hardware (microphone, speakers, OS settings, etc.)
    • Your mobile carrier, internet service provider, or Wi-Fi network
    • Circumstances beyond our reasonable control.
  4. Recording and Storage
    • We may record or store audio and/or transcripts of AI Voice Interaction sessions to:
      • Maintain and improve service quality
      • Prevent abuse, fraud, or misuse
      • Comply with legal obligations
      • Improve and develop features and models, where allowed by law and in accordance with our Privacy Policy.
    • Where required by law, we will provide notice and/or obtain your consent before recording.
    • You must not record or share Voice Interaction or chat content in a way that violates privacy, wiretapping, or recording laws in your jurisdiction, or that infringes third-party rights.

8. User Obligations and Prohibited Conduct

You agree not to use the Service to:

  1. Violate any applicable law, regulation, or these Terms
  2. Defame, harass, threaten, or abuse any individual or group, or promote discrimination or hatred
  3. Encourage or glorify self-harm, suicide, violence, or criminal acts
  4. Impersonate any person or entity, including our employees or representatives
  5. Collect, store, or disclose another person’s personal information without proper authorization
  6. Upload, share, or distribute malware, viruses, spyware, phishing content, spam, or other malicious code
  7. Attempt to access, probe, or interfere with our servers, networks, or security systems without authorization
  8. Use automated means (scraping, crawling, bots, etc.) to access the Service in ways not explicitly permitted by us
  9. Use the Service’s outputs as if they were certified professional advice (e.g., presenting them as medical, legal, or other regulated professional services) for third parties
  10. Engage in any behavior that materially disrupts the Service or harms us or other users.

If we determine that you have engaged in prohibited conduct, we may:

  • Remove or restrict access to offending content
  • Suspend, limit, or terminate your account
  • Forfeit Balance associated with your account where permitted by law
  • Report unlawful activities to relevant authorities.

9. Intellectual Property and User Content

  1. Our Rights
  2. All software, source code, design, logos, text, images, user interface, AI prompts and system logic, and other materials provided through the Service (collectively, “Fortunepia Content”) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

  3. License to Use the Service
  4. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Fortunepia Content for your personal, non-commercial use, in accordance with these Terms.

  5. User Content
    • “User Content” means any data, text, audio, or other material that you input, upload, or transmit through the Service, including:
      • Birth data (such as date, time, and place of birth) that you voluntarily provide when you request astrology-based features
      • Personal background, context, or concerns you choose to share
      • Messages and audio content in chats or AI Voice Interaction
      • Any other materials you choose to provide.
    • You retain ownership of your User Content, subject to any rights of third parties.
    • By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:
      • Use, reproduce, store, process, and create derivative works from your User Content
      • Provide and operate the Service for you and other users
      • Maintain, improve, and develop the Service (including models and features), where permitted by law and consistent with our Privacy Policy
      • Comply with legal obligations and respond to disputes.
  6. Third-Party Rights
  7. You are responsible for ensuring that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or rights of publicity. If your User Content leads to a dispute, you will be solely responsible.

  8. Restrictions
  9. Except where allowed by applicable law, you must not:

    • Copy, modify, distribute, publicly display, or create derivative works based on Fortunepia Content without our prior written consent
    • Reverse engineer, decompile, or disassemble the Service or any associated technology, except to the extent that applicable law permits such activity notwithstanding this limitation.

10. Changes to the Service and Account Termination

  1. No Guarantee of Continuous Availability
  2. We will use commercially reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, system issues, or circumstances beyond our control.

  3. Changes to the Service
    • We may modify, add, or remove features, content, or pricing at any time.
    • If a material change negatively affects paid services that you have already purchased but not yet used, we will use reasonable efforts to provide equivalent value or refunds as required by law.
  4. Our Right to Suspend or Terminate
  5. We may suspend or terminate your access to the Service or your account if:

    • You violate these Terms or applicable law
    • Your use creates risk or possible legal exposure for us or other users
    • We are required to do so by law, court order, or regulatory authority.
  6. Your Right to Terminate
  7. You may stop using the Service at any time and may request deletion of your account in accordance with our Privacy Policy.

  8. Effect of Termination
  9. Upon termination of your account:

    • Your right to use the Service will cease
    • Any remaining Balance may be handled in accordance with Section 6 and applicable law (including possible forfeiture)
    • Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will remain in effect.

11. Disclaimers

To the maximum extent permitted by applicable law:

  1. “As Is” and “As Available”
  2. The Service and all outputs (including chats, AI Voice Interaction, reports, horoscopes, and other content) are provided “as is” and “as available”, without any warranty of any kind.

  3. No Warranties
  4. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

    • Implied warranties of merchantability
    • Fitness for a particular purpose
    • Non-infringement
    • Accuracy, reliability, completeness, or timeliness of any content or results.
  5. No Guarantee of Outcomes
  6. We do not warrant or guarantee that:

    • Any predictions, readings, or interpretations will be accurate or realized
    • The Service will meet your expectations
    • Using the Service will result in any particular outcome.
  7. Third-Party Services
  8. We are not responsible for any third-party services, websites, payment systems, telecom networks, or other third-party offerings, even if linked to or integrated with the Service.

12. Limitation of Liability

To the extent permitted by law:

  1. Excluded Damages
  2. We, our affiliates, and our respective officers, directors, employees, and agents shall not be liable for any:

    • Indirect, incidental, consequential, special, or punitive damages
    • Loss of profits, revenue, data, or goodwill
    • Emotional distress or loss of opportunity

arising out of or related to your use of (or inability to use) the Service, whether based on contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

  1. Cap on Liability
  2. Our total aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of:

    • The total amount you actually paid to us for the Service during the 12 months preceding the event giving rise to the claim; or
    • USD 200 (or equivalent).
  3. Non-Excludable Liability
  4. Some jurisdictions do not allow certain exclusions or limitations of liability. In such cases, the above limitations apply only to the extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, certain consumer protection rights or damage caused by willful misconduct).

13. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of any third-party rights, including intellectual property or privacy rights.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

14. Governing Law and Jurisdiction

  • Governing Law
  • These Terms and any dispute or claim arising out of or in connection with the Service shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict-of-law principles

  • Jurisdiction
  • Any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the Seoul Central District Court in the Republic of Korea, except to the extent that applicable mandatory consumer protection laws grant you the right to bring claims in another court.

15. Changes to These Terms

  1. We may modify or update these Terms from time to time for reasons including changes in law, improvements to the Service, or operational needs.
  2. If we make material changes, we will:
    • Indicate the “Last Updated” date at the top; and/or
    • Provide notice within the Service (e.g., via in-app notice) or by email.
  3. The updated Terms will take effect on the effective date specified.
  4. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may request deletion of your account.
